Guide for Residents: How to Object or Comment on Public Participation Processes

1. Why your comment matters

The municipality must consider public comments and objections before finalising decisions such as:

  • Closing a public road
  • Selling municipal land
  • Approving development rights

Residents therefore have the legal right to support, comment on, or object to the application.

2. Who can submit comments

Anyone may submit comments, including:

  • Property owners
  • Tenants
  • Businesses
  • Community groups
  • Any member of the public affected by the proposal

You do not need to be a lawyer to object.

3. What you should include in your comment

Your comment should include:

Your details

  • Full name and surname
  • Physical address
  • Contact number or email

Reference to the application

  • Property description (for example: Portion of Road Erf 513, Napier – Trade Street)
  • Application type (road closure / alienation / subdivision)

Your concerns or comments
Explain clearly how the proposal affects you or the community.

Possible issues residents may raise include:

  • Loss of public road access
  • Traffic circulation and safety
  • Access to neighbouring properties
  • Impact on municipal services in the road reserve
  • Whether the land is still needed for public use
  • Whether the disposal of municipal land is in the public interest
  • Environmental or planning concerns
  • Fairness and transparency of the process

You may also ask the municipality to:

  • refuse the application, or
  • reconsider the proposal.

4. Supporting information (optional)

If possible, attach:

  • photographs
  • maps
  • statements from neighbours
  • petitions or letters of support

This can strengthen your submission.

5. Where to submit your objection or comment

Submit your written comments to the municipality before the closing date stated in the public notice.

Comments can usually be submitted:

  • By email to the municipal planning department – info@capeagulhas.gov.za
  • By hand delivery to the municipal offices
  • By registered mail
  • Send a copy to your ward councilor. – ‘Raymond Ross’ RaymondR@capeagulhas.gov.za
  • Copy to the residents assocation – info@napierresidents.co.za

Always keep a copy of your submission.

6. What happens after you submit

After the closing date:

  1. Municipal officials review all comments.
  2. The comments are included in a report to the municipal decision-making body.
  3. The decision-maker must consider public input before making a final decision.

7. Important tips

  • Be clear and factual.
  • Focus on how the proposal affects you or the community.
  • Submit before the closing date.
  • Encourage neighbours to submit individual comments.

Multiple submissions from residents help demonstrate the level of community concern.

Your participation helps ensure that municipal decisions consider the interests of the whole community.
